Morat \u0107ete potpisati neku vrstu ugovora, poput <a href=\"https:\/\/zaposlise.hr\/blog\/ugovor-o-djelu-za-honorarni-posao\/\">ugovora o djelu<\/a>.<\/p>\n<p>No, ako zaposlenik mora raditi nedjeljom i blagdanima, on ima svoja prava. Prema <a href=\"https:\/\/www.zakon.hr\/z\/307\/Zakon-o-radu\" target=\"_blank\" rel=\"noopener\">Zakonu o radu<\/a> zaposlenik ima pravo na tjedni odmor u neprekidnom trajanju od najmanje dvadeset \u010detiri sata.<\/p>\n<p>Tom odmoru se pribraja dnevni odmor kojeg radnik koristi nedjeljom i dan koji prethodi nedjelji ili koji slijedi nedjelji.<\/p>\n<p>Ponekad zaposlenik nije u mogu\u0107nosti koristiti odmor na taj na\u010din. Poslodavac mora radniku isplatiti pove\u0107anu pla\u0107u.<\/p>\n<p>To pravo imaju svi zaposlenici, neovisno u kojoj djelatnosti rade. Svejedno radi li se o poslu u trgovini ili o nekoj industriji u kojoj se ne mora nu\u017eno raditi 24 sata dnevno.<\/p>\n<p>Tako\u0111er se ovdje ubrajaju poslovi koji se po prirodi stvari moraju raditi bez prestanka. Neki od primjera su javni prijevoz i lije\u010denje u bolnicama.<\/p>\n<p>Za sve navedene poslove i one koje nismo naveli, poslodavac mora isplatiti dostojanstvenu pla\u0107u. No, unato\u010d tome, zaposlenik \u0107e ostvariti pravo na primjereno pove\u0107anje <a href=\"https:\/\/zaposlise.hr\/blog\/minimalna-placa-za-2025-je-970-eura-bruto\/\">pla\u0107e<\/a>.<\/p>\n<p>Ukratko, spominjali smo Zakon o radu. Nije je propisan najni\u017ei dodatak za pla\u0107u za rad nedjeljom i blagdanima. Zadnje izmjene i dopune Zakona su stupile na snagu po\u010detkom 2023. godine<\/p>\n<blockquote><p>Taj dodatak je bio prete\u017eito u visini od 30 ili 35% na <a href=\"https:\/\/www.minimax.hr\/hr-hr\/rad-nedjeljom-i-u-dane-blagdana\" target=\"_blank\" rel=\"noopener\">osnovnu pla\u0107u radnika<\/a>, a od tada je definirano da ne smije biti u iznosu ni\u017eem od 50%.<\/p><\/blockquote>\n<h2><span class=\"ez-toc-section\" id=\"Povecana_placa_za_rad_u_vrijeme_blagdana\"><\/span>Pove\u0107ana pla\u0107a za rad u vrijeme blagdana<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Vrijeme je blagdana i neki od moraju raditi. Privatnici i honorarni radnici sami odre\u0111uju svoju satnicu. Pro\u010ditajte i koliko iznosi pla\u0107a kod <a href=\"https:\/\/zaposlise.hr\/blog\/koliko-uistinu-iznosi-placa-kod-privatnika\/\">privatnika<\/a>.<\/p>\n<p>No, zaposleni u tvrtkama za dane blagdana ostvaruju naknade pla\u0107e. K tome, radnom zakonodavstvu je propisano da:<\/p>\n<ul>\n<li>Radnik ima pravo na naknadu <a href=\"https:\/\/www.minimax.hr\/hr-hr\/rad-nedjeljom-i-u-dane-blagdana\" target=\"_blank\" rel=\"noopener\">pla\u0107e<\/a> za razdoblja u kojima ne radi zbog opravdanih razloga odre\u0111enih zakonom, drugim propisom, kolektivnim ugovorom, pravilnikom o radu ili ugovorom o radu.<\/li>\n<li>Ako nekim od navedenih akata nije druk\u010dije odre\u0111eno, radnik ima pravo na naknadu pla\u0107e u visini <a href=\"https:\/\/www.minimax.hr\/hr-hr\/rad-nedjeljom-i-u-dane-blagdana\" target=\"_blank\" rel=\"noopener\">prosje\u010dne pla\u0107e<\/a> koja mu je ispla\u0107ena u prethodna tri mjeseca.<\/li>\n<li>Ako radnik u prethodna tri mjeseca nije ostvario pla\u0107u, visina naknade pla\u0107e se odre\u0111uje u odnosu na visinu one pla\u0107e koju bi radnik u istom razdoblju ostvario opravdanog razloga radi kojeg mu pripada pravo na tu naknadu.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Kako_se_utvrduje_povecanje_place\"><\/span>Kako se utvr\u0111uje pove\u0107anje pla\u0107e?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Pove\u0107ana pla\u0107a koju poslodavac mora isplatiti zaposleniku je iz sljede\u0107ih razloga:<\/p>\n<p>Za prekovremeni rad.<\/p>\n<p>No\u0107ni rad.<\/p>\n<p>Rad nedjeljom.<\/p>\n<p>Za rad u dane blagdana.<\/p>\n<p>Za neradne dane koji su propisani posebnim zakonima.<\/p>\n<p>Za rad u ote\u017eanim radnim uvjetima.<\/p>\n<blockquote><p>Ti se dodaci obra\u010dunavaju na osnovicu odre\u0111enu izvorom radnog prava kojim su kod poslodavca ure\u0111ene pla\u0107e, ali ne smiju biti obra\u010dunani na osnovicu manju od <a href=\"https:\/\/www.minimax.hr\/hr-hr\/rad-nedjeljom-i-u-dane-blagdana\" target=\"_blank\" rel=\"noopener\">minimalne pla\u0107e<\/a>.<\/p><\/blockquote>\n<p>Ukratko, prema Zakonu poslodavac he du\u017ean dati pove\u0107anje na pla\u0107u samo za rad nedjeljom i to prema propisanim pravilima.<\/p>\n<div id=\"attachment_10669\" style=\"width: 1103px\" class=\"wp-caption kolektivnim ugovorom ili ugovorom\/pravilnikom o radu.<\/p>\n<p>Na primjer:<\/p>\n<blockquote><p>Iako se uobi\u010dajeno odre\u0111uje u visini od 30 do 50 %, nema zapreke da <a href=\"https:\/\/www.minimax.hr\/hr-hr\/rad-nedjeljom-i-u-dane-blagdana\" target=\"_blank\" rel=\"noopener\">poslodavac<\/a> odredi i minimalno pove\u0107anje od npr. 1% i time udovolji zakonskim odredbama.<\/p><\/blockquote>\n<p>No, premda Zakon o radu nije naveo to\u010dan iznos pove\u0107anja pla\u0107e za rad na blagdane, poslodavcima nije dozvoljeno dati pove\u0107anje od npr. jednog eura.<\/p>\n<p>Ipak isti Zakon jasno propisuje da je pove\u0107anje pla\u0107e za ote\u017eane uvjete rada, prekovremene, za no\u0107ni rad i rad blagdanima utvr\u0111eno.<\/p>\n<p>I ako sam ugovor o radu ne sadr\u017ei dovoljno podataka na kojima bi se moglo odrediti pove\u0107anje, radnik \u0107e ipak ostvariti primjereno pove\u0107anje
