Ta iznimka odnosi se na kolektivni vi\u0161ak radnika. Tada\u00a0poslodavac ispla\u0107uje otpremninu ako prihvatite raskid ugovora o radu.<\/p>\n<p>Ovog prolje\u0107a smo imali takav primjer na Hrvatskoj radioteleviziji. \u010celnici su ponudili otpremnine zaposlenicima koji prihvate raskid ugovora o radu.<\/p>\n<p>Tada je do 31. o\u017eujka <a href=\"http:\/\/hrt.hr\" target=\"_blank\" rel=\"noopener\">HRT<\/a> napustilo 333 zaposlenika. Ti zaposlenici potpisali su\u00a0sporazumni raskid ugovora o radu na temelju Odluke o uvjetima i visini otpremnine.<\/p>\n<p>Time vidimo primjer kako jedna tvrtka mo\u017eete vlastitim pravilnikom o radu donijeti odluku o raskidu ugovora i davanju otpremnine.<\/p>\n<p>Uz to, postoje jo\u0161 neki uvjeti za dobivanje otpremnine. Pro\u010ditajte!<\/em><\/p>\n<p>Jasno se vidi kako bi zaposlenici sa\u010duvali svoje zdravlje, a tvrtka u\u0161tedila, da se jasno provodila zakonom propisana za\u0161tita na radu na radnom mjestu.<\/p>\n<p>I zadnja iznimka kod primanja otpremnine odnosi se na slu\u010daj ste\u010daja poslodavca. U takvim okolnostima zaposlenik ima pravo na otpremninu u visini polovice iznosa koji je propisan zakonom.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Koliko_iznosi_otpremnina\"><\/span>Koliko iznosi otpremnina?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Iznos otpremnine ovisi o du\u017eini radnog odnosa (bez prekida) na istom radnom mjestu i iznosu bruto pla\u0107e.<\/p>\n<p><em>Niste sigurni kako izra\u010dunati bruto pla\u0107u ili \u0161to je sve uklju\u010deno u taj iznos? Pro\u010ditajte na\u0161 \u010dlanak o na\u010dinu kako se obra\u010dunava<\/em><strong><em><a href=\"https:\/\/zaposlise.hr\/blog\/placa-sto-je-bruto-a-sto-neto\/\">bruto pla\u0107a<\/a>. <\/em><\/strong><\/p>\n<p>Naime, veliki broj osoba &#8220;vidi&#8221; jedino iznos pla\u0107e koji se nalazi na teku\u0107em ra\u010dunu. Naime, iznos je ograni\u010den\u00a0na najvi\u0161e \u0161est prosje\u010dnih mjese\u010dnih pla\u0107a.<\/p>\n<p>Va\u017eno je da su te pla\u0107e ostvarene u zadnjih tri mjeseca otkad je prestao va\u017eiti ugovor o djelu.<\/p>\n<blockquote><p><span style=\"font-size: 14pt\">U posebnim slu\u010dajevima zakon odre\u0111uje vi\u0161u (ozljeda na radu) ili ni\u017eu (ste\u010daj poslodavca) otpremninu od minimalno propisane.<\/span><\/p><\/blockquote>\n<p>Taj podatak smo saznali u <a href=\"https:\/\/www.zakon.hr\/z\/307\/zakon-o-radu\" target=\"_blank\" rel=\"noopener\">Zakonu o radu<\/a>.<\/p>\n<p>Poslodavac mo\u017ee imati dobru volju odrediti iznos otpremnine kako mu odgovara. Tako mo\u017ee iznositi i vi\u0161e od one propisane zakonom. Pro\u010ditajte u nastavku.<\/p>\n<p>Na primjer, poslodavac 21. listopada 2021. godine svom zaposleniku uru\u010dio <strong><a href=\"https:\/\/zaposlise.hr\/blog\/poslovno-uvjetovani-otkaz-sto-trebate-znati\/\">poslovno uvjetovani otkaz<\/a><\/strong>. Na njega zaposlenik ima zakonsko pravo na otpremninu.<\/p>\n<p>Taj je zaposlenik bio bez prekida zaposlen u istoj tvrtki od 1.rujna 2011. godine. Iznos pla\u0107e koju prima je 1.600 eura bruto. Kada istekne otkazni rok, zaposlenik ostvaruje pravo na otpremninu.<\/p>\n<p>Iznos se odnosi na 12 godina navr\u0161enog radnog sta\u017ea. Time dobije po 533,33 eura za svaku godinu, \u0161to ukupno iznosi 6.400 eura. Niste sigurni koji su trenutno aktualni? Pro\u010ditajte na\u0161 \u010dlanak o<strong> <a href=\"https:\/\/zaposlise.hr\/blog\/placa-novi-porezni-propisi-za-2025\/\">poreznim propisima<\/a><\/strong> za 2025. godinu.\u00a0<\/em><\/p>\n<p>Zatim, za usporedbu, zaposlenik koji je primao istu pla\u0107u, ali je radio 20 godina, zakonska otpremnina iznosi 7.200 eura. Radi se o\u00a0\u0161est prosje\u010dnih bruto pla\u0107a, a sav ispla\u0107eni iznos bio bi neoporeziv.<\/p>\n<p>Primjer ide dalje ovako &#8211; ako je kolektivnim ugovorom ili pravilnikom zaposlenik imao pravo na otpremninu koja je dvostruko ve\u0107a od zakonske ( 10.66,66 eura za svaku godinu rada), tada bi imao i porezne obveze.<\/p>\n<p>Na obra\u010dunatu otpremninu od 12.800 eura neoporezivo bi isplatio 10.352,52 eura (12&#215;862,71). No, na preostalih 2447,48 eura morao bi dati\u00a0obvezne doprinose i poreze.<\/p>\n<p>Zato bi taj preostali\u00a0dio otpremnine bio umanjen ovisno o kategoriji poreznog obveznika.<\/p>\n<p><em>Nadamo se da ne\u0107ete nikada morati oti\u0107i s posla protiv svoje volje.
